  1. Why do we need Planning Permission, or a Building Plan Approval?

Under the Town and Country Planning Act, any building construction must obtain Planning Permission from the CMDA, City Municipal Corporation, Municipality Township or Panchayat Union. A building plot can be converted from agricultural land by having planning permission.

  1. Where can I get Building Plan Approval?

CMDA office or Municipality Township or Panchayat Union must receive the filled-out form before the plan can be approved by the government. The forms are divided into two categories. The form “A” is used to lay out the land for building purposes while the form “B” is used for all other developments, such as residential and commercial buildings. By paying the application fee, you can obtain the form from these offices (Chennai City Municipal Corporation or Municipality Township or Panchayat Union). The CMDA office does not sell forms for these applications, you must submit them directly to the Corporation or local body.

  1. When does a planning permit for construction expire?

It is valid for 3 years once you get the government’s permission. If you apply within the validity period, you can renew the planning permission for another 3 years. You probably won’t even have time to begin the construction if you purchase a plot whose planning permission is about to expire, but you will have spent more money than you would have on a normal plot.

  1. What documents do you need to submit with your application?

Plans with the following information should be submitted 5 copies:

  • The site plan must include a detailed floor plan of the proposed building indicating its dimensions and setback from the property lines.
  • Detailed Plan, Elevation and Section details of the proposed building.
  • Site plan, showing where the site is located. An Architect or a Licensed Building Surveyor (LBS) needs to sign all plans and applications.
  • Obtain the necessary clearances (when necessary)
  • Establish your title to the land with a Deed of Sale or Lease and Patta.
  1. What is the cost of a planning permission application?

Costs vary across the country for submitting a planning application. Permission costs depend on the size of the land, the construction area of the building, and the number of kitchens. For example, if the land is 1000 square feet and the build-up area is 2000 square feet taking into consideration the maximum floor area ratio, which is two, and for one kitchen the cost would be approximately Rs.50,000 -80,000/- (as of 2021 – an approximate costing is provided here).

It may vary depending on where you are. After submitting the plans and documents to the concerned authority, it is possible to determine the real costs of obtaining planning permission. You should also keep in mind that you must also pay a licensed building surveyor for the plan to be submitted with the application.

  1. When do I need building Plan Approval and Planning Permissions?

A new dwelling (whether you’re constructing it from scratch or subdividing an existing structure) requires planning permission. A building that has already been built needs planning permission to add another floor. Adding a modular kitchen or improving the interior of your home won’t need government permission.

  1. What Are the Benefits of Consulting a Planning Consultant?

Before buying a plot of land, you should consult a planner to avoid spending tons of money on a project that turns out not to be feasible. Consultants with experience in this area will recommend the best option based on their knowledge. Additionally, getting government approval can be time-consuming and even stressful most of the time; it is best to leave it to the professionals.

  1. Who is responsible for approving the building plan?

In the case of multi-story buildings (over 4 floors or in excess of 10,000 square feet) and special buildings (ground + 3 floors), applications should be submitted directly to the CMDA. According to the location of the application, other ordinary building plans can be submitted to the Chennai City Municipal Corporation / Municipality / Town Panchayat / Panchayat Union.

  1. How will planning permission be granted?

The Master Plan or Detailed Development Plan will be used to determine whether permission will be granted. These plans must comply with the Development Regulations. Planning permission or building plan approval will not be granted if the development regulations are not met by the concerned government office.

Before granting planning permission, your site will be inspected by the Building Plan Inspector / Town Planning Officer of the Local Body / CMDA Officers.

  1. Can the design be altered after obtaining Planning Permission or Building Plan Approval?

Minor alterations can be made to the Master plan that you have submitted to CMDA. If you intend to make major changes to an approved plan, you must obtain permission from the authority. If the original master plan needs to be approved, a revised version should be submitted with the deviations. Before applying for approval of a building plan, you should decide what needs to be changed.

Yes, for a building to be constructed, you need planning permission. The Act makes it possible to demolish or keep under lock and seal structures when taken without proper permission.
